Administrative and Regulatory Law Disputes

With power, comes the potential for abuse of power. The framers of the Constitution were well aware of this and took pains to include a variety of checks, balances and other safeguards against it.

At Barrie L. Goldstein, LLC, we advocate for individuals, business clients, organizations and others who are engaged in disputes with local, state, federal or regulatory agencies of all types in western Connecticut and southeastern New York.

Attorney Barrie L. Goldstein has been practicing law for more than 30 years. She has worked as a lawyer for the federal government at the U.S. Department of Justice, for the State of New York as Special Litigation Counsel, and as private counsel for individuals, businesses and groups of people with claims against government entities.

In practice, these government and private practice experiences have given Ms. Goldstein detailed knowledge of the constitutional, administrative, regulatory and state laws that apply in these cases, and has provided her with keen insights on getting things done, where to go and who to talk to when your client has a problem that needs to be addressed.

Government Consultant Services

In addition to handling private claims and intra-governmental disputes — Ms. Goldstein also provides consulting services to local municipalities, boards, commissions and other entities with concerns involving employment law, administrative and regulatory law, due process compliance and a broad range of other issues.

Selected Reported Cases

  • Ahrens v. Bowen, 646 F. Supp. 1041 (E.D.N.Y. 1986). This case involved a challenge to New York's practice, under the Home Relief Program, of reclaiming fines recovered by patients for nursing home abuses.

  • Fields v. Axelrod, 134 A.D.2d 589 (2nd Dep't 1987), a litigation involving a revocation of dentist's license for breach of professional duties established under state law.

  • Glasco v. Hills, 558 F.2d 179 (3rd Cir. 1977). This case involved a challenge to HUD's rent control regulations on federally unsubsidized housing.

  • Krauskopf v. Perales, 146 M.2d 619 (Sup. Ct. N.Y. Co. 1990), aff'd as modified, 173 A.D.2d 387 (1st Dep't 1991). This was New York City's challenge to the state audit's finding that the City owed the State $35 million for its failure to close its welfare cases in "timely" fashion.
